FAQ
What is a Violation?
• From official point of view the word „violation” it usually means that someone did not comply with a law, rule or agreement.
• When common folk use the word „violation” they usually mean that they received a „notice of violation” from NYC DOB.
Who is responsible for fixing the violation?
Life is not fair. Ultimately the owner is responsible for all building violations. No matter who created the deficiency:
•Previous owner (good luck finding them)
•Contractor (the company just resolved)
•Neighbor (go ahead and sew me)
•It fell apart (it will not put itself back together)
•It was always like that (Codes change)
If you can not fix it – a „Professional”.
•The proces to remove violation varies but the steps are usually very simillar:
•Hire a professional and figgure out the remedy that suits you and will satisfy the violation issuer
•Attend a Hearing to try and close out violation without work/minimise penalties
•File an application to do the work and wait for approval (if you start too early you may end up having more violatons)
•Get a permit (just because your application is filed does not mean you can work)
•Lift any Stop work orders (Just because you got a permit does not mean you can work)
•Do the work and any interim/special/progress inspections
•Close out the Permit and do the final inspections.
•Close out applicaton by filing inspection certifications.
•Pay Penalties.
•Close out Violation by having another inspection
